F.A.C.T – Terms & Conditions of Service
Fast Action Construction & Transportation (F.A.C.T)
By requesting, scheduling, or using services from Fast Action Construction & Transportation (“F.A.C.T,” “we,” “us,” or “our”), you (“the Customer”) agree to the following Terms & Conditions.
1. Services Provided
F.A.C.T provides services including, but not limited to:
- Hauling and freight transport
- Moving and delivery services
- Debris and material removal
- Light repair, maintenance, and fix-it services
- Construction and property support
Services may vary by project and are limited to what is agreed upon in writing or verbally prior to service.
2. Estimates & Pricing
- Estimates are based on information provided by the Customer and may change if job conditions differ.
- Pricing may be hourly, flat-rate, or per-load, depending on the service.
- Additional labor, materials, time, distance, disposal fees, or unforeseen conditions may result in added charges.
- F.A.C.T does not guarantee final pricing unless stated in writing.
3. Payment Terms
- Payment is due upon completion of service, unless otherwise agreed in writing.
- F.A.C.T reserves the right to request partial or full payment upfront.
- Accepted payment methods will be disclosed prior to service.
- Late or unpaid balances may result in service refusal and additional fees.
4. Cancellations & Rescheduling
- Customers must provide at least 24 hours’ notice to cancel or reschedule.
- Same-day cancellations or no-shows may result in a cancellation fee.
- F.A.C.T reserves the right to reschedule due to weather, safety concerns, equipment issues, or emergencies.
5. Customer Responsibilities
The Customer agrees to:
- Provide accurate job details and safe access to the work area
- Ensure items are legal, safe, and allowed for transport or disposal
- Secure pets, children, and valuables away from work zones
- Disclose hazardous materials or unsafe conditions in advance
F.A.C.T reserves the right to refuse service if conditions are unsafe or illegal.
6. Property & Item Handling
- F.A.C.T takes reasonable care when handling property and items.
- F.A.C.T is not responsible for pre-existing damage, fragile items not disclosed, or items improperly packed by the Customer.
- Customer must inspect work and items upon completion and report concerns immediately.
7. Damage & Liability
- F.A.C.T is not liable for damage caused by:
- Structural weaknesses
- Hidden defects
- Overloaded items
- Customer-provided equipment
- Normal wear and tear
- Liability is limited to the cost of the service provided, unless otherwise required by law.
8. Repairs & Fix-It Services
- Repair services are limited in scope and do not replace licensed specialty trades unless explicitly stated.
- F.A.C.T does not guarantee outcomes affected by existing damage, age, or structural issues.
- No warranties are implied unless provided in writing.
9. Delays & Force Majeure
F.A.C.T is not responsible for delays caused by weather, traffic, supply shortages, acts of God, or circumstances beyond our control.
10. Refusal of Service
F.A.C.T reserves the right to refuse or stop service for:
- Unsafe or hostile environments
- Illegal materials or requests
- Non-payment or non-compliance with terms
- Misrepresentation of job details
11. Indemnification
The Customer agrees to hold F.A.C.T harmless from claims, damages, or losses resulting from:
- Customer negligence
- Undisclosed hazards
- Violation of these Terms & Conditions
12. Governing Law
These Terms & Conditions are governed by the laws of the State of Iowa.
13. Acceptance of Terms
By scheduling or receiving services from F.A.C.T, the Customer acknowledges and agrees to these Terms & Conditions in full.
